Dear Lakes at Castle Rock Residents:
The Board of Directors has been receiving feedback from several homeowners related to the use of the Association’s facilities such as the pool, tennis courts, etc. This feedback has been both in favor of closures, as well as against facilities closures. There have been questions related to the Board’s authority to restrict access to these common areas or facilities, and whether these temporary closures should result in a reduction in monthly assessments.
The Board voted by unanimous written consent to take this action. This was not a decision that was taken lightly, and was done in consideration for and the protection of the health and safety of the members and residents.
This action is permitted by the Association’s documents that allow for the establishment of rules and regulations pertaining to or restricting the use of the common area. The temporary closure of the facilities will not impact the assessment rate established by the Board through the 2020 Budget, as no offsets or credits against assessments are permitted, per the CC&Rs. Although use may be temporarily prohibited at this time, please remember that there are still maintenance expenses to be incurred now and in the future for these facilities.
These closures do not prohibit the use of the various walking paths, or use of the lawns and lake fronts. Please continue to utilize these assets of the Association while practicing proper social distancing and hand washing to help protect each other and the Community at large.
We understand that this action may cause frustration for some within the Community. It is our hope that you understand the action taken by the Board in an effort help promote the health and safety of all Lakes at Castle Rock members, residents, and our guests.
It is the goal of the Board to re-open the facilities as soon as possible. Stay safe, and we will keep you apprised of any changes.
